Wind pool claims in South Carolina: how an SCWHUA policy differs from your homeowners policyReclamos del wind pool en Carolina del Sur: en qué se diferencia una póliza de la SCWHUA de tu póliza de vivienda

If you live near the beach in Horry, Georgetown, Charleston, Colleton or Beaufort County, there is a good chance your homeowners policy does not cover wind and hail at all. That coverage comes from a second policy written by the South Carolina Wind and Hail Underwriting Association, the state wind pool, usually called SCWHUA. After a hurricane, that second policy changes who you call, how much you pay out of pocket and how the claim is adjusted.

What the wind pool is, and why you have itQué es el wind pool y por qué lo tienes

The wind pool was created by state law (S.C. Code § 38-75-330) as the insurer of last resort for wind and hail in the coastal area: when no private company will write that coverage for a property, the Association does. Every property insurer licensed in South Carolina is a member and shares its losses.

  • Where it applies. The statutory coastal area covers the beaches and barrier islands of the five coastal counties: east of the Intracoastal Waterway in Beaufort and Colleton, east of a line near U.S. Highway 17 Business in Horry and Georgetown, and listed islands and areas in Charleston County. Since 2007 the Department of Insurance has expanded that area by order, most recently Order 2025-02 of March 20, 2025, in effect through March 28, 2027. Policies are rated in two zones: Zone 1 closer to the ocean, Zone 2 further inland.
  • How you got it. A South Carolina-licensed agent applied for you, usually because the company writing your homeowners policy excluded wind and hail. The Department's 2025 coastal market report counts about 15,300 wind pool policies, most in Horry, Beaufort and Charleston counties.
  • What that means on paper. You hold at least two policies for one house: a homeowners policy that excludes wind and hail, and a wind pool policy that covers only wind and hail. Flood insurance, if you bought it, is a third. Each has its own declarations page, deductible and limits.

After a storm: one house, two or three claimsDespués de una tormenta: una casa, dos o tres reclamos

What caused each piece of damage decides which policy pays for it, and after a storm the pieces are mixed together.

  • Wind and hail go to the wind pool. Shingles torn off, siding stripped, a tree through the roof and rain that came in through an opening the wind created are typically wind pool claims. The Association adjusts them with its own staff and the independent adjusters it hires; your homeowners carrier will not inspect that damage.
  • Everything else goes to the homeowners policy. Fire, theft, a burst pipe, water from a source other than the storm. Rising water from storm surge or a flooded creek is flood, and FEMA is clear that standard homeowners policies do not cover it; that takes a flood policy, usually through the NFIP.
  • Read the wind pool form, not your old HO-3. It covers wind and hail only. Whether it also pays for contents, other structures, debris removal or extra living expenses depends on the coverages and limits on your declarations page.
  • The named storm deductible. On the coast it is usually a percentage of the dwelling coverage, not of the loss. Under S.C. Regulation 69-56 it applies only to a hurricane, tropical storm or tropical depression named by the National Weather Service or the National Hurricane Center, and the insurer must give you a written example on a $100,000 policy and a disclosure that it "MAY RESULT IN HIGH OUT-OF-POCKET EXPENSES TO YOU." A 3% deductible on a $400,000 dwelling limit is $12,000 before the first dollar is paid.
  • When the two insurers point at each other. The wind adjuster calls the stain water damage; the homeowners adjuster says it came through the roof. Evidence settles it: photos of the opening, the water line, the order of events and a room-by-room list that separates wind damage from everything else. Ask each insurer for its position in writing.

Deadlines, deductibles and your rights in South CarolinaPlazos, deducibles y tus derechos en Carolina del Sur

The wind pool is a state-created association, but your policy is still an insurance contract under South Carolina law. Report each claim promptly and in writing, and photograph everything before you tarp or clean.

  • Insurer deadlines. South Carolina requires insurers to handle claims with reasonable promptness (S.C. Code § 38-59-20). If an insurer refuses to pay within 90 days of a demand without reasonable cause, a court may award attorney's fees (§ 38-59-40). The general deadline to sue on a policy is 3 years; read your own policy's suit-limitation clause and confirm the date with an attorney.
  • Public adjuster rules. In South Carolina the public adjuster's fee must be stated in a written contract signed by both sides, and it is paid only from what is recovered (§ 38-48-80). You may cancel that contract until the close of business on the fifth business day after signing (§ 38-48-110), and a public adjuster may not also be the contractor who repairs your property (§ 38-48-130).
  • If you are stuck. The Department of Insurance Office of Consumer Services takes complaints at 803-737-6180 or 1-800-768-3467 and asks the insurer to respond. Proactive is licensed in South Carolina and handles wind pool claims from our office in Lawrenceville, Georgia, with a free case review. This page is general information, not legal advice.

Common questionsPreguntas frecuentes

I have a wind pool policy and a homeowners policy. Which one do I call after a hurricane?

Both, and separately. Wind and hail damage, including rain that entered through an opening the wind made, is reported to the wind pool (SCWHUA) through your agent or its claims line. Any other covered damage goes to your homeowners carrier, and rising water to your flood insurer if you have one. Each claim gets its own number, adjuster and deductible.A las dos, y por separado. My named storm deductible is a percentage. A percentage of what?

Of your dwelling coverage limit, not of the damage. A 2% deductible on a $350,000 dwelling limit is $7,000, whether the roof claim is $9,000 or $90,000. Regulation 69-56 requires the insurer to show you a worked example on a $100,000 policy and to disclose the deductible on the declarations page. It applies only to storms named by the National Weather Service or the National Hurricane Center; an unnamed storm usually falls under the smaller wind/hail or standard deductible, so check the dates.
